According to TMZ, the former 90 Day Fiancé star has hired a private medical examiner to challenge the state’s ruling that the baby’s passing was “non‑accidental.” Eric told TMZ he strongly disagrees with the conclusions made by Adams County Health and Human Services and claims his independent examiner found major issues with how the original autopsy was conducted, including uncertainty about the age of a fracture mentioned in the report.

TMZ reports that Eric’s private examiner suggested one of the injuries could have occurred during childbirth, noting the baby was delivered via C‑section just five weeks earlier. The examiner also argued that a rib fracture cited in the investigation may have happened during CPR attempts, explaining that ribs can break during resuscitation. Eric said he and Leida confronted HHS over what they believe are incorrect assumptions and insisted that the sheriff’s department has not found Leida responsible. He also claimed they asked authorities months ago to review additional information, but says HHS refused to consider it.

The situation escalated further when Eric harshly criticized Child Protective Services, calling the agency “the definition of fascism” and accusing it of treating every parent as a suspect. TMZ notes that no criminal charges have been filed and the investigation remains open. Leida has denied any wrongdoing connected to the newborn’s passing, and Eric says the couple has not decided whether they will try for another child. With the case still under review and tensions rising, the controversy surrounding the couple shows no signs of slowing down.
